Peter is the head of Costello Legal’s Insurance Coverage and Appellate Group. His practice focuses on insurance coverage, defense litigation, and appellate law in state and federal courts across the country. He provides pre-litigation guidance and representation to insurance-industry clients in all aspects of coverage/bad faith and defense litigation throughout all phases of a lawsuit including discovery, depositions, pretrial, trial, appeals, and settlement.

Peter’s extensive coverage experience spans several lines including general liability, commercial general liability, cyber liability, data privacy, professional liability, errors and omission, directors and officers, homeowners, personal and business auto, and related policies of insurance. Peter’s experience includes finding solutions to complex legal and coverage issues. His results include:

    • Securing summary judgment in the first Illinois case involving insurance coverage for alleged violations of the Illinois Biometric Information Protection Act.
    • Representing a legal malpractice insurer through trial in rescission of professional liability policy issued to prominent law firm to obtain rescission based on nondisclosure of a $30 million suit which was threatened against insured but not disclosed on application.
    • Representing an insurer in a coverage dispute with respect to an agribusiness package policy issued to an animal confined feeding operation (CAFO) when lawsuit was filed against the CAFO operator for alleged pollution discharged into public water supply.
    • Representing insurer in coverage dispute under CGL and business interruption parts to a package policy where a major supplier of animal feed allegedly neglected to add vitamin d supplement to animal feed causing rickets and death in $12 million worth of livestock.
    • Representing insurer in coverage dispute with fire protection district under Management Liability part to package policy when district stood accused in engaging in a monopoly when it passed regulation to terminate existing commercial fire alarm contracts within its borders in favor of exclusive contract with one company.
    • Securing multiple victories for property and casualty insurer concerning claims for defense and indemnification for construction litigation.

Peter’s appellate career began as an elbow clerk to an Illinois Appellate Justice where Peter drafted over 150 precedential court opinions and dispositive orders. Since then he has participated and secured favorable results in many major pieces of litigation at the posttrial and appellate level including the following:

    • Obtaining victory before the Illinois Supreme Court, successfully challenging the constitutionality of Public Act 98-1132, Senate Bill 3075, which reduced the number of jurors in a civil trial in State of Illinois from 12 to 6.
    • Representing a major Chicago hospital in posttrial proceedings following $53 million verdict in Cook County for child born with cerebral palsy and other health defects due to allegations of faulty prenatal and delivery care. Case settled for confidential sum well below jury verdict following the filing of appellate brief.
    • Representing a steel manufacturer in post-trial and appellate proceedings following a $34 million verdict in favor of a plaintiff injured in accident caused by driver of an intermodal transport company after jury found manufacturer, driver, and intermodal company in a joint venture.
    • Obtaining victory before the 7th Circuit in an appeal from the dismissal of a $34 million complaint filed by Bank of America against an accounting firm for alleged misrepresentation on a valuation statement used to obtain a loan for the Knight Industries, which went bankrupt.
