Daniel P. Costello
Dan Costello has years of experience concentrating in litigation management, legal solutions, and complex litigation. He actively works with insurance companies to improve their litigation management and claims handling protocols. In 2014, he was selected as of one of four finalists for the Outside Counsel Professional of the Year by Claim and Litigation Management (CLM). Additionally, Mr. Costello is a regular instructor at the Litigation Management Institute (LMI) at Columbia Law School, teaching a course on coverage perspectives
For the last five years he has focused on litigation management, and top flight legal work for national and super regional insurance companies, with a keen focus on carriers in the $1-2 Billion NWP arena. In that role he often works with CLOs, VP of Claims, and key technical officers to jump start litigation management programs, supply proprietary data, and implement data mining solutions. During this time, Mr. Costello’s firm has enjoyed great success, and in 2015 his firm has brought over a dozen cases to trial with a 90%+ win rate, and ten jury trial wins.
Mr. Costello has a deep knowledge in the construction defect arena, and has personally handled over 10,000 construction defect cases both as a litigator and on the claims side. He has been able to utilize this breadth of knowledge to create an innovative new system of controlling defense costs in insurer’s construction defect portfolios. By understanding what defense counsel really needs to do to bring these matters to completion and being able to look at the claims both multiple angles, he can use his team to find ways of controlling costs and providing value that hasn’t been attempted anywhere else.
Dan has substantial corporate business experience. In his time working for a Fortune 500 insurance company he became the youngest National Director of Claims Litigation in the history of the 90 year old company rising to the position in only five and half years. During that time he also focused his attention on litigating the most complex and catastrophic loss cases across the country. Mr. Costello has also been appointed as a member with the Counsel on Litigation Management(CLM) and has spoken all over the country on their behalf. He is also a widely recognized litigator and go to trial attorney. He successfully handled over 100 major jury trials, arbitrations, and mediations.
His bar admissions include the United States Supreme Court, the United States 7th Circuit Court of Appeals, U.S District Court for the Northern District of Illinois Trial and General Bar, U.S. District Court for the Northern District of Indiana, the Illinois Supreme Court, Pro Hac Vice to the Supreme Court of North Dakota 2005, Pro Hac Vice to the Supreme Court of Louisiana 2005, and other states. Mr. Costello is also a member of the American Bar Association, ABA Trial and Insurance Practice Section, and the Chicago Bar Association.
In addition to the CLM, Mr. Costello has also lectured all over the country to insurance companies, businesses, and Fortune 500 companies. He has presented on litigation management, ethical considerations, and construction contracts. He has been recognized as an innovator and leader in integrating law and technology. He has worked with state and federal courts, in the non-profit sector, advising on utilizing the web to promote the spread of information and the rule of law. He is also active in his community contributing legal services and acting as an Executive Council member for the Cara Program. He is also on National Alumni Board for Lewis University.
